European patent -Intervention of the assumed infringer

 

According to Rule 89 and other rules of the European Patent Convention (EPC) Implementing Regulations (IR),

(1)

Notice of intervention shall be filed within three months of the date on which opposition proceedings are instituted.

(2)

Notice of intervention shall be filed in a written reasoned statement; Rules 76 ( regulating form and content of the opposition) and 77 (regulating Rejection of the opposition as inadmissible) of the EPC IR shall apply mutatis mutandis. The notice of intervention shall not be deemed to have been filed until the opposition fee has been paid.
