TRANSFER OF EUROPEAN PATENT APPLICATION

According to the regulations of the European Patent Convention (EPC) a European patent application may be transferred for one or more of the designated EPC contracting states.

An assignment of a European patent application is to be made in writing and requires the signature of the parties to the contract on the patent application transfer.

Registration of transfers
The transfer of a European patent application shall be recorded in the European Patent Register at written request of an interested party, upon production of documents providing evidence of such transfer. (.i.e. signed contract on the patent application transfer and paid administrative fee).

Where a fee is due, the request shall not be deemed to have been filed until the administrative fee has been paid.
A transfer shall have effect vis-à-vis the European Patent Office (EPO) only at the date when and to the extent that the above mentioned conditions have been fulfilled.

The EPO administrative fee for European patent application transfer currently amounts 120,- EUR.
