HOW TO REDUCE OR AVOID PAYMENT OF SOME EUROPEAN PATENT OFFICIAL FEES, FILING FEE

According to the regulations of the European Patent Convention (EPC),

EP - direct applications

A European patent application containing more than 35 pages at the time of filing incurs a additional filing fee in respect of each page in excess of that number.
If the application is filed without claims or by reference to a previously filed application, the additional fee is payable within one month of filing the first set of claims or the certified copy of the application by reference, whichever expires later.
The additional fee is calculated on the basis of the pages of the description, claims, any drawings and one page for the abstract, in the language of filing.

The additional filing fee (as a printing fee) must be paid within one month of filing the application as above explained and according to the actually valid EPO Schedule of fees amounts EUR 18,- for 36^th and each subsequent page.

Euro-PCT applications
 

For international (Euro-PCT) applications entering the European phase on or after 1 April 2009, the additional fee is payable as part of the filing fee within the 31-month period from the date of filing of the international application or, if priority has been claimed, from the priority date.

Any amendments in international (Euro-PCT) applications entering the European phase are also considered part of the international publication and are taken into account for calculating the additional fee to the Filing fee unless the applicant indicates that the procedure in the European phase is not to be based on them.

In accordance with the above mentioned the applicants who wish to avoid payment of the additional filing fee should take care their patent application not to contain more than 35 pages.
