EURO – PCT APPLICATION, WHICH FEES ARE TO BE PAID ON ENTRY INTO EUROPEAN PHASE

According to rule 159 of the European Patent Convention (EPC) Implementing Regulations (IR) and other EPO regulations, the following EPO official fees are to be paid with respect to entry of one International (PCT) Application into European phase:

Filing fee, (for filing online, for application containing up to 35 pages),,,,,,,,,................................................................................................135,- EUR
Search fee,...............................................................................................1.520,- EUR
(where a supplementary European search report has to be drawn up);
Examination fee;.......................................................................................1.915,- EUR
Designation fee;...........................................................................................685,- EUR
Renewal fee in respect of the third year.......................................................690,- EUR

(The amounts of the EPO Official fees are given according to the actually valid EPO Schedule of fees. EPO makes updates of its Schedule of fees each year)

The entry into European phase is to be done within thirty-one months from the date of filing of the application or, if priority has been claimed, from the priority date.

Out of the above listed EPO Official fees the Filing fee and the Search fee are due for payment on the day the European patent application is filed. They must be paid either within one month of that date or, for Euro-PCT applications, within 31 months of the filing date or, where applicable, of the earliest priority claimed.

The Examination fee and Designation fee are to be paid latest up to six months after the date on which the European Patent Bulletin mentions the publication of the European search report.

The Renewal fee for the third year is to be paid on entry into European phase in case until then from filing the international application to have passed two years .
