According to EPO Regulations, the language-related fee reductions are available only to:
small entities ( (a) a micro, small or medium-sized enterprise (b) a natural person; or
(c) a non-profit organisation, university or public research organisation)
having their residence or principal place of business within a contracting state which has a language other than English, French or German as an official language, and
nationals of such a state who are resident abroad.
The request for examination or the application documents must be submitted in an official language of a contracting state other than English, French or German.
The reductions can be claimed by checking the right box in the electronic form provided by the EPO, e.g. by using:
form 1001 (“Request for grant of a European patent”),
form 1200 (“Entry into the European phase”) or,
for pending applications use form 1038 (“Letter accompanying subsequently filed items”) together with form 1011.
